3. Purpose of the Processing of Personal Data
The collection and processing of personal data on Clever Circle Lda.'s website is intended for: (i) sending, upon express request of the user, of product, service and/or budget proposals; (ii) the performance of a contract of sale, including delivery, installation and after-sales support; and (iii) compliance with our legal obligations, in particular invoicing and the keeping of accounting and tax records.
Clever Circle Lda. does not currently send marketing communications and does not operate a mailing list. Should it introduce marketing communications in the future, these will be sent only to users who have given their express consent to receive them, and that consent may be withdrawn at any time as set out in section 9 below.
Where processing is based on your consent, that consent may be revoked at any time, as set out in section
9 below. Where processing is necessary for the performance of a contract or for compliance with a legal obligation, it does not depend on your consent and cannot be revoked, although your other rights under section 5 continue to apply.
In view of the foregoing, Clever Circle Lda. clarifies that it does not request or encourage, in any place or in any way, the submission or transmission of personal data related to philosophical or political beliefs, party or trade union affiliation, religious faith, private life and racial or ethnical origin, as well as the processing of data related to health and sexual life, including genetic data.
Therefore, and if such personal data is transmitted to Clever Circle Lda., it cannot be held liable for their processing under this Privacy Policy.
Without prejudice to other forms of contact with Clever Circle Lda., the non-transmission of personal data by the user prevents Clever Circle Lda. from considering him/her for the purpose of providing products, budgets or other information, as applicable.
4. Maintenance of Personal Data
The period of time during which personal data are stored and maintained will vary in accordance with the aforementioned purposes.
In this regard, it should be clarified that personal data relating to the purposes identified in point 3 above will be maintained this way:

Invoicing, accounting and tax records will be maintained for 10 years, in accordance with article 52 of the Código do IVA, article 123 of the Código do IRC and article 40 of the Código Comercial. This period is counted from the end of the calendar year to which the document relates, and not from the date of the document itself.

The personal data from customers that confirm the purchase as our Terms and Conditions will be maintained for the duration of the warranty and for as long afterwards as a claim connected with the sale may be brought, without prejudice to the retention periods referred to above;

The personal data from customers that ask for budgets and do not confirm the purchase will be maintained during 3 years counting from the date of the last contact between Clever Circle Lda. and the user, without prejudice to the right of the holder to request the suppression of their data at any time, as indicated in section 5 below. Any further contact between the parties restarts that period.

Where marketing communications are introduced in the future, personal data processed on the basis of consent for that purpose will be maintained until that consent is withdrawn.

Longer periods may be applied whenever the situation justifies it, and proportionately to such situation, namely to safeguard the rights of Clever Circle Lda. in the establishment, exercise or defence of a legal claim.
5. Right of access, rectification, deletion, limitation of processing and portability of Personal Data
The user is guaranteed, at any time, the right of access to their personal data, as well as to their rectification, deletion, portability, limitation and/or opposition to the processing. In this regard, the user may exercise any of these rights by addressing in writing to Clever Circle Lda. through the address of the registered office or through the following e-mail: info@heatcraft.pt.
Clever Circle Lda. may request confirmation of the user's identity before acting on a request, so that personal data is not disclosed to the wrong person, and will reply within the period established by the General Data Protection Regulation, which is normally one month and which may be extended where a request is complex or where several requests have been made.
In addition, the user may always present any complaints he/she deems necessary to the competent authority for this purpose, which in Portugal is the Comissão Nacional de Proteção de Dados (CNPD), www.cnpd.pt.
6. Security in the Processing of Personal Data
Personal data will be processed and stored in electronic means and paper format.
Clever Circle Lda. undertakes to ensure the security and protection of personal data you submit to us through the website, having adopted the appropriate measures necessary for this purpose, namely: (i) password protection, (ii) use of digital certificates, (iii) physical entry restrictions to the premises where the personal data storage servers are located; (iv) firewalls, (v) secure communication via https protocol.
Clever Circle Lda. informs that said security measures are reviewed and updated according to the needs and requirements on these matters.
If, for any reason, there is a breach of security that causes, accidentally or unlawfully, the destruction, loss, alteration, disclosure or unauthorised access to personal data, Clever Circle Lda. undertakes, in accordance with the applicable legislation, to notify the competent authorities, without undue delay and, whenever possible, within 72 hours of becoming aware of such occurrence.
In addition, under the terms referred to in the preceding paragraph, Clever Circle Lda. undertakes to report the violation of personal data to the respective holder of said data, in accordance with the applicable legislation.
Notwithstanding the security measures taken by Clever Circle Lda., it is important to point out that the users should also take additional security measures, in particular to ensure that there is an up-to-date active firewall, antivirus and anti-spyware.
7. Communication of Personal Data to Third Parties
In the course of its business, Clever Circle Lda. may use third parties to provide certain services (located inside or outside the European Union), which may imply, in some cases, access by said entities to personal data of users. These include, in particular, delivery, transport and installation contractors, who receive the information necessary to deliver to and install at the user's address, courier and freight companies, website hosting and IT service providers, payment service providers, and our accountant.
In addition, Clever Circle Lda. communicates invoice data, which may include your name, address and tax identification number, to the Portuguese tax authority (Autoridade Tributária e Aduaneira), as it is required by law to do. Personal data may also be disclosed to other public authorities, including courts, where disclosure is required by law or is necessary for the establishment, exercise or defence of a legal claim.
In such a scenario, Clever Circle Lda. requires that any entity having access to such personal data processes it only on Clever Circle Lda.'s documented instructions, keeps it confidential, and applies appropriate technical and organisational measures to protect it. These requirements are set out in writing in a data processing agreement entered into between Clever Circle Lda. and the third party or parties concerned, in accordance with Article 28 of the General Data Protection Regulation.
In fact, any entity sub-contracted by Clever Circle Lda. will process the personal data of users, on its behalf and account, undertaking to take the necessary technical and organisational measures to protect personal data against accidental or unlawful destruction, accidental loss, alteration, dissemination or unauthorised access, and against any other form of unlawful processing.
In any case, Clever Circle Lda. remains responsible for the processing of personal data.
Where necessary, and within the scope of sub-contracting of third parties by Clever Circle Lda., personal data may be transferred to outside the European Union, under the terms and conditions permitted by the applicable law, relying on an adequacy decision of the European Commission, on standard contractual clauses approved by the European Commission, or on another lawful transfer mechanism. Information about the safeguards applying to a particular transfer may be requested using the contact details above.
Clever Circle Lda. may change the individual companies referred to in this section from time to time without updating this Privacy Policy, provided that the categories of recipient and the safeguards applied remain the same.
8. Right to be Forgotten
The holder of personal data has the right to obtain from the person responsible for the processing of personal data the deletion of his/her personal data, who, in turn, will be obliged to delete them, whenever one of the following reasons applies: (i) data are no longer necessary for the purpose for which they were collected or processed; (ii) the holder withdraws consent, when the consent is the legal basis or the holder opposes the processing and there are no prevailing legitimate interests justifying their maintenance.
This right does not apply where Clever Circle Lda. is required to retain the data in order to comply with a legal obligation, or where retention is necessary for the establishment, exercise or defence of a legal claim.
